Fotherby v. Cowan, 2012 NSCA 59 Factum

The following is a copy of the original Factum filed by Ms. Fotherby with the Nova Scotia Court of Appeal in the matter of Fotherby v. Cowan, 2012 NSCA 59. This case is part of the story that depicts the neverending battle the Fotherby's have been subjected to in Nova Scotia while trying to promote sustainable education and trying to build an educational center so that average people can learn about the hidden alternative energy technologies. The courts turned this event into a landlord/tenant dispute and ignored the fact that the agreement in question was a contract where each party had obligations to the other. I thought it would be useful for anyone researching the case to have online access to "other side" of the story, rather than just the online court decision  :)
